Perika uTeEnah 4 – Parshas MishpatimParshas BereishisParshas VayeraApitropus – Taking an Oath – Rav Avrohom Sternhartz zalYerusha – Inheritance – Last Will – Speaker: Rabbi Nasan Maimon.
Hilkhos Perika uTeEnah 4 is based on 2Likutey Moharan 2.
00 – PARAGRAPH 30b. Apitropus – guardian – appointed by a child’s father to establish matters of yerusha – inheritance.
00 – PARAGRAPH 31.
40 – The process of yerusha through apitropus generates the light of honesty, as inתִּתֵּן אֱמֶת לְיַעֲקֹב חֶסֶד לְאַבְרָהָם אֲשֶׁר־נִשְׁבַּעְתָּ לַאֲבֹתֵינוּ מִימֵי קֶדֶם – “You shall give the truth of Yaakov, the loving-kindness of Avraham, which You swore to our forefathers from days of yore” (Michah 7:20).
30 – Parshas Mishpatim. אִם־לֹא יִמָּצֵא הַגַּנָּב וְנִקְרַב בַּעַל־הַבַּיִת אֶל־הָאֱלֹהִים – “If the thief is not found, the homeowner shall approach the judges, [to swear]…” (Shemos 22:7, Mishpatim).
30 – Conflict caused by denial of the truth pertaining to financial matters is related to the process of the blood gathering to the heart, as in אַנְשֵׁי דָמִים יִשְׂנְאוּ־תָם וִישָׁרִים יְבַקְשׁוּ נַפְשׁוֹ – “People of blood hate the innocent, but the upright seek his soul” (Mishlei 29:10).
00 – Shvuah – taking an oath is a concept of hiskashrus. It’s an example of the 3 channels of אמת shining into the 4 aspects of speech. Reference to Likutey Halakhos, Yoreh Deah 2, Kiley Beheyma 4. When a person swears, he holds a Sefer Torah and speaks the Name of HaShem, establishing a deep connection between his speech and the highest levels of אמת.
45 – NOTE from the Bnei Yissa’char: The 22 basic letters of the Torah are the male aspect of HaShem plus the 5 “ending letters” ם – ן – ץ – ף – ך – equal 27. 27 times Y – K – V – K is begematria Shabbos. That’s why the Zohar HaKodesh brings that Shabbos is an aspect of Shem HaShem.
00 – Q&R about a woman’s role in inheritance.
00 – PARAGRAPH 32. Parshas Vayeira. כִּי יְדַעְתִּיו לְמַעַן אֲשֶׁר יְצַוֶּה אֶת־בָּנָיו וְאֶת־בֵּיתוֹ אַחֲרָיו וְשָׁמְרוּ דֶּרֶךְ יְהוָה לַעֲשׂוֹת צְדָקָה וּמִשְׁפָּט – “For I have known him because he commands his sons and his household after him, that they should keep the way of HaShem to perform righteousness and justice…” (Bereishis 18:19, Vayeira). The most important final will a person can leave for his surviving family is to follow the Torah’s ways in tzedakah and mishpat.
40 – Q&R about performance criteria in a will.
00 – Judges must arrive at the אמת in order to establish אֱמֶת וּמִשְׁפַּט שָׁלוֹם שִׁפְטוּ בְּשַׁעֲרֵיכֶם – “…truth, and judgment of peace you shall judge in your cities” (Zecharia 8:16).
00 – Parshas Bereishis. וַיְהִי־עֶרֶב וַיְהִי־בֹקֶר יוֹם אֶחָד – “…and it was evening and it was morning, one day” (Bereishis 1:5, Bereishis). The words “Yom Echad” instead of “Yom Rishon” established forever the unity of everything HaShem created.
00 – NOTE – The word אמת unites the first and last letters of the Aleph-Beis.
00 – PARAGRAPH 34. בֵּאלֹהִים אֲהַלֵּל דָּבָר בַּיהוָה אֲהַלֵּל דָּבָר – “Through HaShem’s [judgement] I will praise His word; through HaShem’s [kindness] I will praise His word” (Tehillim 56:11).
00 – ***NOTE – This world is not “vacation village” – everyone is struggling. When a person thinks they have it worse than others, this is a form of self-deception that prevents him from fulfilling his potential.
00 – Through praising HaShem and the study of Torah, a person becomes one with HaShem. And by doing this, the person will be rescued from all his difficulties.
00 – NOTE – When a Breslov chassid was mocked for falling down, he replied: “I fell because of my sins. I got up because I’m Breslov”.
00 – The importance of being at peace with Am Yisrael.
00 – NOTE: First line of Mizmor LeSodah – מִזְמ֥וֹר לְתוֹדָ֑ה הָרִֽיעוּ לַֽ֜יהֹוָ֗ה כָּל־הָאָֽרֶץ – “A song for a thanksgiving offering. Shout to HaShem, all the earth” (Tehillim 100).
00 – Q&R about the practical application of the principles brought in the shiur. Closing one’s eyes to the pain of this world. Reference to Likutey Moharan 65.
00 – BIOGRAPHICAL NOTE about Rav Avrohom Sternhartz zal. When people sought counsel from him, he would bring them to an entirely new level of consciousness and gratitude to HaShem.
00 – Q&R about the difference between men and women in applying principles brought in this shiur.
