Shutafin 3 – Shutafin 4 – Business Transaction Requires Kinyan – Hand of Yaakov vs. Heel of Esav – Sheker – Changing Business Deal – Taavos Mamon Contains Every Type of Avoda Zara – Speaker: Rabbi Nasan Maimon.
Hilkhos Shutafin 3 is based on 2Likutey Moharan 8.
00 – PARAGRAPH 7.
00 – PARAGRAPH 8.
00 – PARAGRAPH 9. A partnership is not official until a kinyan is made. A kinyan must be done with the hands (through written contract and/or kinyan sudar) in order to establish the union of partners, both in monetarily and spiritually.
00 – HALAKHA 4. A partnership requires a kinyan. Hilkhos Shutafin 4 is based on Likutey Moharan 23.
00 – PARAGRAPH 1. All the various types of Sutra Achra are present in money. Profit is only from HaShem. When a person puts his life in danger in order to “make a profit” it is considered as if he is worshiping idols.
20 – When a person is free of the Sutra Achra present in money, his light is illuminated with joy. When a person is steeped in taavos mamon, his face is an aspect of the “Seventy Faces of Darkness”.
00 – Teivas Mamon is related to Tikkun HaBris. If it were not for salt, a person would not be able to stand the bitterness of this world. The world is filled with the bitterness of chasing parnassah. In some ways, the anxiety regarding money is more bitter than death.
00 – The Tzaddik is “the salt of the world”.
30 – A person who opposed the Tzaddik sinks into taavos mamon, which is an aspect of Avoda Zara and Shmad.
30 – PARAGRAPH 2. No business transaction is completed with words alone. There must be a kinyan to prevent partners changing their mind and changing the deal.
40 – When a person goes back on his word it’s as if he worships idols.
00 – Q&R about keeping one’s word. “Nine o’clock means nine o’clock.” A person’s word is not a joke.
00 – Q&R – a person needs to consult a Torah authority about when to let a person go if they don’t keep their word.
30 – Q&R about the characteristics of the 70 Nations. Reference to Sipurey Maasios – Story of the Baal Tefilah.
10 – PARAGRAPH 3. A business transaction is not completed with words alone, because all parties involved cannot rely on the word of the others. The hands of all involved in the agreement must be involved, either through writing or kinyan. Reference to Likutey Moharan 22.
00 – Yaakov Avinu told his sons to physically destroy the idols found in Eretz Yisrael.
40 – ***A business partnership is not established unless there is a written document. Until there is a kinyan, the parnassah of the people involved can be put “on hold” because there is no kli to receive it. “Business is a very dangerous thing, because all forms of idolatry are involved.” Idol worship prevents a person from receiving parnassah.
Two are better than one, since they have good reward for their toil” (Koheles 4:9).
00 – The Tzaddik is compared with salt, which sweetens the bitterness of the world, so opposition of the Tzaddik results in a person’s bitterness with regard to taavos mamon.
00 – Closing blessings.
